Governor Siminalayi Fubara Faces Impeachment as Rivers State Assembly Commences Proceedings

In a dramatic escalation of the political crisis in Rivers State, the State House of Assembly has formally initiated impeachment proceedings against Governor Siminalayi Fubara and his deputy, Ngozi Oduh. This move, supported by at least 26 lawmakers, sets the stage for a major constitutional and political battle.

The Grounds for Impeachment

During a plenary session presided over by Speaker Martins Amaewhule, the Majority Leader, Major Jack, cited seven specific allegations of gross misconduct against Governor Fubara. Relying on Section 188 of the 1999 Nigerian Constitution, the key charges include:

· Financial Misconduct: Accusations of extra-budgetary spending and withholding funds meant for the Assembly Service Commission.
· Obstruction of the Legislature: Demolition of the state Assembly Complex and refusal to obey a Supreme Court ruling on financial autonomy for the legislature.
· Constitutional Violations: A failure to present budgets and seek approval from the legitimate state Assembly, among other issues.

Parallel allegations were also read against Deputy Governor Ngozi Oduh, including reckless spending and obstructing the Assembly.

The Impeachment Process

The constitutional process is now underway. According to the Speaker, the formal notices of allegations will be served on Governor Fubara and his deputy within the next seven days. This action triggers the formal process outlined in the constitution, allowing the governor time to respond.

The Underlying Political Crisis

This development is not an isolated event but the latest act in a prolonged political conflict that has gripped Nigeria’s oil-rich state. The impeachment proceedings are intrinsically linked to a deep-seated rift between Governor Fubara and his predecessor, Nyesom Wike, who is now the Minister of the Federal Capital Territory (FCT).

· Breach of Agreement: The impeachment move comes days after Wike publicly accused Fubara of reneging on a peace agreement brokered by President Bola Tinubu in mid-2025 to resolve the state’s crisis.
· Party Defections: The political landscape has been fluid, with Fubara recently defecting from the Peoples Democratic Party (PDP) to the ruling All Progressives Congress (APC). This followed the defection of 16 pro-Wike lawmakers from the PDP to the APC, altering the Assembly’s power dynamics.
· History of Federal Intervention: The crisis has been so severe that President Tinubu declared a six-month state of emergency in Rivers State in March 2025, suspending Fubara and the Assembly and appointing a federal administrator. This emergency rule was lifted in September 2025.

This impeachment process marks a critical and volatile new phase in the struggle for control of Rivers State. As the constitutional procedures unfold, all political actors in the state and at the national level will be watching closely.
