The Supreme Court gave former President Donald Trump a huge victory on Monday when it ruled that states cannot prevent him from seeking public office because of his actions before the January 6 attack on the Capitol. This ruling swiftly put an end to a case that would have profound effects on the election of 2024.
The court reversed the Colorado Supreme Court’s ruling, which had found that Trump was unable to run for president again under the criteria of section 3 of the 14th Amendment, in an unsigned judgment with no dissent.
According to the court, the Colorado Supreme Court erroneously believed that states have the authority to decide whether a presidential candidate is disqualified under a 14th Amendment clause of the Constitution.
The decision establishes that Congress, not the states, must establish guidelines for enforcing the 14th Amendment’s provisions. As a result, not just Colorado but all states are covered by the ruling.
“Because the Constitution makes Congress, rather than the states, responsible for enforcing section 3 against all federal officeholders and candidates, we reverse,” the ruling said. [CONTINUE READING HERE]
