Court Invalidates LP’s Governorship Victory in Abia State Due to Electoral Act Violation

In a significant turn of events, the victory of the Labour Party (LP) and its governorship candidate, Mr. Otti, in the March 2023 election in Abia State has been invalidated by the court.

The ruling came as a result of a lawsuit filed by Mr. Ibrahim Haruna Ibrahim against the Labour Party and the Independent National Electoral Commission (INEC).

The court, in suit No FHC/KN/CS/107/2023, determined that the process leading to the selection of LP’s candidates was not in accordance with the requirements outlined in the 2022 electoral act.

Specifically, the court pointed out the Labour Party’s failure to submit its membership register to INEC at least 30 days prior to their primaries, which ultimately invalidated the entire selection process.

Justice Yunusa, delivering the ruling, emphasized that a party that fails to comply with the provisions of the electoral act cannot be considered to have a valid candidate in an election. Consequently, the votes credited to the LP candidate were deemed wasted votes.

This ruling has undoubtedly had a profound impact on the outcome of the election and raised questions regarding the legitimacy of LP’s victory in Abia State.

The court’s decision serves as a reminder of the importance of adhering to electoral laws and regulations. The electoral act is designed to ensure a fair and transparent electoral process, and any deviation from its provisions can have far-reaching consequences.

In addition to the electoral setback, the Labour Party in Abia State is currently grappling with a leadership crisis. Two factions have emerged within the party, each vying for control.

On one side, there is the faction led by Lamidi Apapa, while on the other, the Julius Abure-led faction fights to maintain its influence within the party. This internal strife further complicates the party’s political landscape and adds to the challenges they face in regaining their footing in Abia State.

The court’s ruling has undoubtedly dealt a blow to LP’s aspirations in Abia State, and it remains to be seen how the party will navigate these challenges.

As the LP leadership crisis persists, it becomes increasingly important for the party to find a resolution and present a united front if they intend to regain the trust of the electorate and remain a relevant political force in the state.
