Court’s ruling: INEC heads to court over BVAS re-configuration

The Independent National Electoral Commission, INEC has revealed that the commission will today approach the Court of Appeal seeking to set aside an earlier ruling concerning the Biometric Voter Accreditation System.

This was disclosed by a senior official of the electoral commission, who pleaded not to be named over the weekend in Abuja, Federal Capital Territory.

The official said, “We have to approach the court to grant us leave to do the re-configuration, as this cannot be done without the court order. The re-configuration must be done on time as it would be done manually and would be deployed to the designated PUs.”

Recalled that the court ordered that INEC to allow Peter Obi and Atiku Abubakar to inspect election materials which was held on the 25th of February, 2023.

A panel of the appellate court led by Justice Joseph Ikyegh made the ruling after it heard two separate ex-parte applications the two aggrieved presidential candidates filed alongside their political parties.

Cited as Respondents in the matter were the electoral commission, that had acclaimed winner of the presidential election, Asiwaju Bola Ahmed Tinubu, as well as his party, the All Progressives Congress, APC.

Both applications were predicated on Section146 (1) of the Electoral Act 2022, Paragraph 47 (1, 2 &3) of the First Schedule of the Electoral Act of 2022, as well as under the inherent jurisdiction of the Court as referenced by Section 6 (6) A & B of the 1999 Constitution, as amended.
