The chairman of the tribunal panel has struck out the case made against the Nigerian Vice President, Kashim Shettima. The judge read that the judgement on the case of the APM is solely on the non-qualification of Bola Tinubu and Kashim Shettima to contest the election.
According to Haruna Tsammani, the APM lacks the locus standi to challenge the nomination of the candidates of another political party.
“Case of disqualification of Shettima to contest as running mate to Bola Tinubu is a pre-election issue, therefore incompetent and accordingly struck out. Besides, the Presidential candidate picks his Running Mate, according to the law. This petition lacks merit whatsoever….” the judge said.
What the judge added, saying,
“In Alhassan and others versus Ishaku and others, it was held that an election tribunal has no jurisdiction on the primary of a political party,” he said.
He said the matters of qualification and disqualification are guided by the provisions of sections 131.
